Actress Natassia Malthe told Harvey Weinstein’s Los Angeles rape trial how she saw a prostitute perform oral sex on him in a hotel room when she dropped off an audition tape before he tried then to make him have a threesome with them.

Malthe, 48, revealed this while testifying at the disgraced Hollywood mogul’s sex crimes trial on Wednesday, November 16.

The model and actress shared how Weinstein lured her to his hotel room on the pretense that she was delivering an audition tape to him.

But when he arrived, she instead found him having sex with a prostitute, and the couple tried to lure her into an orgy.

She described the pressure of the situation, saying Weinstein had her “by the f*****g throat,” because if she didn’t “comply” with his advances, she knew her career would be derailed.

During her testimony, Malthe also recounted how Weinstein had previously raped her in a hotel earlier that year, to invite her to audition for one of his films the next day.

The heartbreaking testimony came the same day the judge dismissed four sexual assault charges against him after one of his accusers – Jane Doe 5 – withdrew from the case.

Malthe said Weinstein was considering casting her in a musical film, and after months of singing lessons and practice, she recorded her voice and informed him by email that she wanted to send him a sample.

She clarified that she wanted to send him the sample CD instead of delivering it in person in order to avoid seeing him as it had only been months earlier since he had raped her.

Weinstein, however, said he wanted the sample delivered in person and insisted in his response email that she bring it to his assistant at the Peninsula Hotel in New York.

Malthe said that in his email, Weinstein mentioned they had a threesome together. she replied that she didn’t want a ‘handkerchief’ with him.

“I’m not the kind of person to do a threesome, I’m just not wired that way,” she testified.

“I said I didn’t want any tissues. I told him.

Malthe said she agreed to drop off the CD at the hotel, but upon arrival Weinstein’s assistant refused to take it and instead insisted that she deliver it to Weinstein in person.

“I tried to give her the CD and she said ‘no, Mr. Weinstein wants you to follow me and talk about the movie.

Realizing Weinstein was trying to get her into his room, Malthe said she was thinking “fuck it” as the assistant led her into the room.

Once in the hotel room, she said Weinstein tossed his CD aside with a chuckle, and when she turned around, his assistant was gone.

“He tricked me into going to his hotel. Suddenly I’m in his hotel room,” she said.

Malthe burst into tears remembering the prostitute and her skinny legs. And they were trying to get me to have a threesome with them. And I had already said that I didn’t want to.

She said Weinstein and the other woman started laughing together at Malthe’s shyness. She said the woman then began giving Weinstein oral sex.

“And this prostitute, who I think is a prostitute. It’s like “oh, she’s so shy” and she and Weinstein were laughing. And she gave him a blowjob.

“I was always trying to deal with the situation because I really wanted to be able to make a quality film,” Malthe testified.

“She persuaded me to go, go, and put on a dress.”

“It’s got you by the throat, knowing that if you don’t comply your career is in the water, knowing that this thing you’ve been working on for months. And that’s not good.

Malthe said that just months before the encounter, Weinstein raped her after knocking on her hotel room door in the middle of the night and demanding to be let in.

“He was just standing there, his shirt was a little ruffled, his pants were ruffled. He looked like he had been somewhere else, he didn’t look very neat. He just burst in,” she testified.

“He said nobody can be like an A-lister unless it comes through me.”

“His name was Harvey a phone call away, which means he could make or break you, he was the most powerful person in Hollywood, he created stars, he could make a movie disappear by putting it on the shelf, he was a genius.’

“I was so scared of this guy, he had so much power…he embodied the movie industry,” she said. “I just thought this guy was so powerful that I didn’t know what to do in this situation and completely froze.”

She said he told her to “think about all the Oscars” people had won and thanked him and said “everyone has to go through him, which is to comply”.

“He took off his pants and pushed me onto the bed and climbed on top of me and I said ‘I don’t do the casting couch thing.’

“I looked into the blanket on my bed and he penetrated me.”

“It didn’t last that long because I got no response because I just played dead. He got off of me and finished himself. He ejaculated into her hand. She said Weinstein then left the hotel room, and the next day she found a script waiting for her in her room.

Superior Court Judge Lisa Lench dismissed two counts of forcible rape and two counts of oral copulation against the disgraced 70-year-old movie mogul – related to two alleged incidents, one in November 2009 and the other in November 2010.

Weinstein, the man who became the face of #MeToo allegations five years ago, is already serving a 23-year prison sentence for sex crimes in New York.
